1. Scope and acceptance
These Términos of Service govern DigiTrustly certification, verification, public certificate, seal, Portal del cliente and payment services. By applying for certification, purchasing an assessment or certification service, using a DigiTrustly account, or displaying DigiTrustly certification materials, the relevant customer agrees to these Términos and any program-specific criteria presented during the process.
2. Nature of DigiTrustly certification
DigiTrustly provides independent private certification and verification services. Unless specifically stated otherwise for a particular program, DigiTrustly is not a government authority, regulator, statutory body or ISO accreditation body.
A DigiTrustly certificate means that DigiTrustly assessed the stated subject under the applicable DigiTrustly criteria and granted certification for the stated scope and period. Certification is not a guarantee of legal compliance, cybersecurity, commercial success, solvency, future behaviour, product quality or the absence of complaints.
3. Applications and applicant responsibilities
Applicants must provide complete, accurate and current information and must have authority to request certification for the website, organisation, release, service or other subject submitted.
DigiTrustly may request supporting evidence, clarification or corrective action. Materially false, incomplete or misleading information may lead to rejection, suspension or revocation.
4. Assessment fees
The assessment fee covers the work involved in reviewing an application, including technical checks, human review and the certification decision process.
Paying an assessment fee does not create a right to certification. An application may be approved, rejected, deferred or returned for more information.
Where DigiTrustly publishes an assessment fee before application, the applicant should be shown that amount before payment.
5. Certification decisions
DigiTrustly may approve, reject, defer or request further evidence based on the applicable criteria and available information. A rejection means DigiTrustly did not grant certification under the relevant review; it does not necessarily mean that the applicant or its activities are unlawful.
Certification decisions may include conditions, required corrections, scope limitations or follow-up review where appropriate.
6. Certification pricing after approval
If an application is approved, the customer may be offered available certification periods. DigiTrustly may display these prices publicly before application for transparency, but a certification period cannot be purchased until the customer has successfully completed the assessment unless DigiTrustly expressly states otherwise.

Published prices may change for future purchases. The price shown and accepted at checkout governs the relevant purchase, subject to applicable taxes and mandatory law.
7. Certificate, seal and logo use
Approved customers receive only a limited right to display official DigiTrustly certification materials for the subject identified in the certificate and only while certification remains valid.
- Certificate IDs must not be altered or reused for another subject.
- QR codes must not be redirected to misleading or unrelated content.
- DigiTrustly seals must not be edited in a way that changes their meaning or current status.
- Customers must not suggest that certification applies to unrelated websites, organisations, products, releases or services.
- Suspended, revoked or expired certification must not be represented as active.
The existence of a copied logo, screenshot or badge without a valid public record is not proof of certification.
8. Suspension, revocation and status changes
DigiTrustly may suspend or revoke certification where reasonably justified. Reasons may include material non-compliance, misuse of certification materials, false or misleading information, fraud, security abuse, significant changes to the certified subject, refusal to provide relevant information or conduct inconsistent with the certification criteria.
Public certificate records may continue to display historical status after suspension, revocation or expiry so that third parties can verify that the certificate is no longer active.
9. Certification periods, renewal and reassessment
Certification is valid only for the applicable period associated with the purchase and certificate. Unless an automatic-renewal arrangement is expressly offered and accepted, DigiTrustly certification does not renew automatically.
DigiTrustly may require updated evidence or reassessment for renewal or during a longer certification period where reasonably necessary to maintain certification integrity.
10. Cancellation, withdrawal and refunds
Assessment fees pay for review work. Once assessment work has begun or been completed, the assessment fee is generally not refundable merely because certification is refused, subject always to mandatory rights under applicable law.
Certification-period fees are paid for the selected certification service period. A customer's decision to stop displaying or using certification does not automatically create a right to a full or pro-rata refund.
Suspension or revocation due to breach, misuse, fraud or non-compliance does not automatically create a right to a refund.
11. Portal del cliente accounts and security
Customers are responsible for keeping credentials confidential and for activity reasonably attributable to their accounts. DigiTrustly may use additional security measures such as one-time email codes.
DigiTrustly may temporarily restrict access where necessary to investigate suspicious activity, protect the platform or maintain certification integrity.
12. Intellectual property
DigiTrustly names, logos, seals, certificate layouts, website content, software and other brand materials remain owned by DigiTrustly or the relevant rights holder.
Certification grants only the limited permission necessary to display official certification materials in accordance with these Términos and any applicable brand instructions.
13. Acceptable use
Users may not forge certificates, manipulate verification status, impersonate certified entities, misuse DigiTrustly branding, interfere with service operation, bypass access controls, attempt unauthorised access or use the service to create a false impression of approval.
14. Disclaimers and limitation of liability
DigiTrustly aims to perform its services with reasonable care. However, DigiTrustly cannot guarantee uninterrupted availability, permanent compatibility with third-party services, error-free external providers or that a certified subject will remain unchanged after assessment.
To the maximum extent permitted by applicable law, DigiTrustly is not liable for indirect, incidental, special or consequential loss arising solely from reliance on a certificate or public verification record. Nothing in these Términos limits liability that cannot legally be excluded or limited.
15. Third-party services
DigiTrustly may rely on third parties for hosting, infrastructure, email, payments, security or other technical services. Those providers may have their own terms and privacy practices.
DigiTrustly is not responsible for the independent acts or outages of third parties except to the extent required by applicable law.
16. Changes to services, criteria or Términos
DigiTrustly may improve or modify services, certification criteria and these Términos. Material changes affecting an existing paid certification relationship should be handled reasonably and consistently with applicable law.
The version published on DigiTrustly applies from the “Last updated” date shown above unless a different effective date is expressly stated.
17. Governing law and disputes
Applicable law and jurisdiction may depend on the DigiTrustly operating entity, the customer's location and mandatory consumer or commercial rules. Mandatory consumer protections and jurisdiction rights remain unaffected where they apply.
Before commencing formal proceedings, customers are encouraged to contact DigiTrustly so that the matter can first be reviewed directly.
